Endless Sunday Terms & Conditions of Service / Build

ENDLESS SUNDAY – TERMS & CONDITIONS (BUILD SERVICES)

1. Custom Build Nature

All Endless Sunday builds are bespoke, made-to-order projects tailored to each client’s specifications.

By proceeding with a build, you acknowledge that your project is custom-designed and not a pre-manufactured or stock item. Each build is unique and may involve specialised sourcing, fabrication, and labour.

2. Deposits & Acceptance

A deposit is required to secure your position in the production schedule.

Payment of a deposit confirms your acceptance of these Terms & Conditions and authorises Endless Sunday to commence work on your build, including parts procurement, labour allocation, and scheduling.

3. Build Timeframes

Estimated build timeframes are typically between 6 to 12 months from the date of the final payment required to commence or continue the build, depending on the scope and complexity of the project.

Where a build is commenced prior to final payment, timeframes will be assessed based on the stage of work and production scheduling at the time.

Delays in client payments may impact build timelines and production scheduling.

All timeframes are estimates only and are not guaranteed.

You acknowledge that timelines may be affected by factors outside of Endless Sunday’s control, including but not limited to:

Supplier delays

Parts availability

Freight and logistics

Custom fabrication requirements

Such delays do not constitute a failure of service.

4. Progress & Communication

Endless Sunday will undertake reasonable efforts to progress each build in accordance with its production schedule.

Clients may request updates at any time, and periodic updates may be provided throughout the build.

5. Payments & Costs

All payments made contribute toward:

Labour completed

Parts purchased or ordered

Production time allocated

Due to the nature of custom builds, costs are incurred progressively throughout the project.

6. Cancellations & Refunds

Due to the bespoke nature of each build, refunds are not available for change of mind.

Where work has commenced, any amounts paid reflect labour, parts, and costs already incurred.

If a client requests cancellation:

Endless Sunday will assess the stage of the build

A cost reconciliation will be conducted

Any potential refund will be limited to amounts not yet allocated to labour, parts, or production costs

Refunds, if applicable, are not automatic and will be assessed on a case-by-case basis.

7. Delays & External Dependencies

Endless Sunday relies on third-party suppliers for specialised components.

You acknowledge that delays caused by third parties or external factors are outside of Endless Sunday’s control and do not constitute grounds for cancellation or refund.

8. Storage & Uncollected Builds

Once a build is complete, clients will be notified for collection.

If a completed build is not collected within a reasonable timeframe:

Storage fees may apply

Endless Sunday reserves the right to take reasonable steps to recover costs in accordance with applicable laws

9. Limitation of Liability

To the extent permitted by law, Endless Sunday is not liable for delays or impacts arising from circumstances beyond its control.

10. Australian Consumer Law

These Terms & Conditions operate alongside your rights under the Australian Consumer Law.

Nothing in these Terms is intended to exclude, restrict, or modify any rights you may have under the Australian Consumer Law (ACL).
